Procedure
Free Speech and Public Assembly Provisions
Navarro College affirms its commitment to freedom of speech and expression, a foundational principle of a vibrant and engaged academic community. This procedure outlines the guidelines for expressive activities and public assembly on campus and locations, consistent with the U.S. Constitution and the requirements of Texas state law, including Senate Bill 2972, which was passed during the 89th Legislative Session. It is intended to ensure the primary educational purpose of the college, which includes promoting debate and the sharing of information, while fostering a safe and respectful environment for all members of the college community.
To ensure the primary educational purpose of the college and to promote a safe and orderly environment, only students enrolled at, and employees of Navarro College are permitted to engage in expressive activities in the common outdoor areas of the campus or location.
External groups are not permitted to engage in expressive activities in the common outdoor areas of the campus without prior authorization. Any external group seeking to use college facilities to engage in expressive activities on campus must be sponsored by a Navarro College department and receive prior approval from the college administration.
The College maintains the right to regulate reasonable time, place, and manner restrictions concerning acts of expression and dissent to ensure campus safety and to prevent disruption to the normal operations of the college. Acts that are disruptive to the normal operations of the college, including but not limited to classes and college business, or acts that invade the rights of others, will not be tolerated. This includes harassment or any infringement upon the rights of others.
External Parties Participation and Request Process
To ensure a safe, orderly, and consistent campus environment, this section applies only to external parties seeking to engage in expressive activity on Navarro College property, including public assembly, demonstration, literature distribution, advocacy, petitioning, solicitation of viewpoints, or other expressive engagement directed to students, employees, or the campus community. This section does not apply to scheduled College-sponsored events, departmental programs, service activities, recruitment activities, vendor arrangements, advisory meetings, camps, competitions, performances, graduations, facility rentals, or other approved College events where the external party is participating through an established department, office, program, contract, or facility-use arrangement and the activity is limited to the approved purpose of that event or partnership. In those situations, the sponsoring department or responsible College office is accountable for managing the external party relationship, event expectations, operational coordination, and compliance with applicable College policies and procedures. If an external party's participation at a scheduled sponsored College event expands beyond the approved event purpose into expressive activity, that expressive activity request must comply with this section.
External party requests covered by this section will be reviewed as expressive activity requests unde rthe requirements below.
- Expressive Activity / Public Assembly / Literature Distribution / Demonstration
- Expressive engagement that occurs outside the approved scope of a scheduled sponsored College event or departmental partnership
Sponsorship and Approval Requirements
External parties must secure sponsorship by a Navarro College department, administrator, or officially recognized student organization prior to participation on campus.
If an external party has not secured an approved sponsor before submitting a request, the external party may contact the Vice President of Student Success Office for the Corsicana campus or the appropriate location dean for all other locations. The Vice President of Student Success Office or location dean may provide general information about the sponsorship and approval process and may make a neutral referral to potential College offices, departments, or recognized student organizations without directing, pressuring, or influencing any sponsorship decision.
Sponsorship is not guaranteed. If an approved sponsor is not confirmed within three business days after the request is referred or after the external party is notified that sponsorship is required, the request will be considered incomplete and will not proceed unless and until the external party secures an approved sponsor and submits any required information for review.
All external party requests are subject to prior review and approval before any activity may occur on college property. Submission of a request does not guarantee sponsorship or approval.
Initial review will be conducted by the Assistant Director of Student Development and Engagement (Corsicana campus) or the location dean, or their designee. Requests involving elevated operational, safety, or policy considerations may be escalated to the Vice President of Student Success for final review.
College sponsorship or approval of an external partner’s presence does not constitute endorsement of the organization or its views.
Expressive Activity (External Parties)
External parties seeking to engage in expressive activity must:
- Complete the Navarro College Free Speech and Public Assembly Request Form
- Secure a sponsoring department or organization
- Receive prior approval from the college
- Conduct all activity within designated expression areas or approved alternate locations
Expressive Activity (Students and Employees)
Students and/or employees seeking to engage in expressive activity must:

Approval decisions will be based on published operational criteria and applied in a content-neutral and viewpoint-neutral manner, consistent with applicable law.
Designated expression areas are intended to provide reasonable and ample alternative means of expression while allowing the college to maintain safe and orderly operations.
Time, Place, and Manner Expectations
All approved external partner activities must comply with Navarro College policies, including but not limited to:
- Maintaining designated locations and not obstructing pedestrian or vehicular movement
- Avoiding material and substantial disruption to college operations, classes, or events
- Complying with restrictions related to noise, amplified sound, and timing
- Following all directives provided by college officials or law enforcement
Failure to comply with these expectations may result in action under the Compliance and Enforcement Procedures below.
Compliance and Enforcement Procedures
Navarro College will make reasonable efforts to resolve violations of the Free Speech and Public Assembly Procedures through education, notice, and voluntary compliance when doing so can be accomplished safely and without materially disrupting College operations, events, classes, access, or the rights of others. The College’s response should be applied in a content-neutral and viewpoint-neutral manner and should be based on conduct, safety, operational impact, and compliance with approved time, place, and manner requirements.
Step 1: Informal education and correction. A designated College official or sponsoring department representative should identify the specific concern, explain the applicable procedure or approved condition, and provide the external party, student, or employee a reasonable opportunity to correct the issue when the conduct does not present an immediate safety concern, legal violation, threat, obstruction, or material disruption.
Step 2: Notice of noncompliance. If the issue continues, the College official should give clear notice that the conduct is not consistent with College policy, the approved request, posted-material requirements, or time, place, and manner expectations. The notice should identify the action required to return to compliance and should advise that failure to comply may result in modification, suspension, termination of the activity, removal from campus, loss of future privileges, or other action consistent with College policy and applicable law.
Step 3: Administrative escalation. If voluntary compliance does not occur, the matter should be escalated to the Assistant Director of Student Development and Engagement, location dean, Vice President of Student Success, or designee, as appropriate. The College may direct the external party, student, or employee to stop the conduct, relocate to an approved area, remove or correct noncompliant materials, reduce noise, modify the activity, meet with a College official before continuing, or end the activity for the day.
Step 4: Sanctions or restrictions. Individuals or organizations that fail to comply after notice may be subject to disciplinary procedures, loss of current or future privileges, denial or revocation of sponsorship or facility-use eligibility, removal from campus, restriction of future access, restitution for damage or costs, criminal trespass warning when appropriate, and other action consistent with College policy and applicable law.
Campus Police involvement. Campus Police should be notified or asked to respond when a situation involves an immediate or potential safety concern; threats, intimidation, harassment, assault, fighting, weapons, property damage, vandalism, or suspected criminal conduct; refusal to leave after an activity has been terminated or access has been restricted; obstruction of building entrances, exits, emergency routes, roadways, parking areas, or pedestrian movement; interference with classes, College operations, approved events, or emergency response; failure to follow a lawful directive from a College official after notice; escalation that requires crowd management, traffic control, protection of persons or property, or issuance of a criminal trespass warning; or any circumstance in which College officials determine that law enforcement presence is necessary to maintain safety or restore orderly operations.
Documentation. The responding College official should document the date, time, location, external party, student(s), employee(s) or organization, sponsoring department, observed conduct, policy or approval condition involved, notice provided, opportunity for voluntary compliance, response from the individual or organization, any corrective action taken, whether Campus Police was contacted, and the final outcome. Documentation should be forwarded to the sponsoring department and the Vice President of Student Success or designee for review and any future access or sponsorship decision.
Operational Coordination
Upon approval, external parties, student, or employee expressive activities may be subject to required coordination with relevant college offices, including but not limited to:
- Campus Police
- Physical Plant
- Information Technology
- Marketing / Public Information
- Contact Center
- Location administration
The Definition of antisemitism, as adopted by the State of Texas in Section 448.001 of the Texas Government Code, is provided as follows: "Antisemitism" means a certain perception of Jews that may be expressed as hatred towards Jews. Acts of antisemitism, disruption to the normal operations of the college (including classes and college business), harassment, or infringement upon the rights of others will not be tolerated.
Faculty, staff, and students engaging in any of the prohibited activities as defined in this procedure, including disruptive or harassing behavior, may be subject to disciplinary action, which may include, but is not limited to, expulsion or dismissal. Any participant in a disruptive activity may also face criminal charges.
Areas Designated For Free Speech and Public Assembly Reservations
The areas listed below are considered programmable space and are available on a first-come first-serve basis to enrolled students and employees; however, college sponsored events have first priority on the use of campus and location grounds. Typically, use of the space will be assigned to the person or organization that requests the area first. Therefore, reservations should be made at least five (5) working days in advance of the event for scheduling purposes.
To ensure all events scheduled in these areas can proceed smoothly during inclement weather, alternate covered spaces have been established for each Navarro College location. These protocols aim to provide alternative spaces while maintaining safety and access for all students, staff, and visitors. If inclement weather is expected on the day of a planned expressive activity, the organization's representative must contact the reserved location’s designated contact person on the morning of the event to be assigned a covered alternative location.
Navarro College - Corsicana
Zone 1 – Primary: Clock Tower/Dining Hall Lawn
Primary designated expression area located on the Clock Tower/Dining Hall lawn area
near Barracks Bunch Clock Tower (36) and Dining Hall (34), as shown on the Corsicana
campus map. Activity must remain within the designated lawn area and may not block
building entrances, sidewalks, pedestrian routes, emergency access, or access to nearby
campus facilities.
Zone 2 – Secondary: Gibson Hall Lawn Area – Southeast Corner
Secondary designated expression area located at the southeast corner of the Gibson
Hall lawn area near Louis Gibson Hall, Fitness Center, Student Center (38), as shown
on the Corsicana campus map. Activity must remain within the designated lawn area
and may not block sidewalks, entrances, parking access, pedestrian routes, emergency
access, or normal operations in and around Gibson Hall.
Inclement Weather Protocols:
During inclement weather, designated expression activity on the Corsicana campus may be relocated to one of the covered weather areas identified on the campus map. The assigned alternate location will be determined based on availability, safety, access, and operational needs. Participants must remain in the assigned covered area and keep all entrances, breezeways, sidewalks, pedestrian routes, and emergency access points clear.
Weather Area A – One-Stop Breezeway, East End
Covered area under the overhang at the northeast corner of the Gooch One -Stop Student Center (24) breezeway, as identified on the Corsicana campus map. Use only the assigned covered concrete area and maintain clear pedestrian movement and building access at all times.
Weather Area B – Gibson Hall Arch
Covered arch area under the overhang located at the South entrance of the Gibson Hall Gym (38). Use only the assignedcovered concrete area and maintain clear entrances, sidewalks, pedestrian routes, and emergency access at all times.
The College reserves the right to adjust or relocate designated expression areas within approved locations as needed to support college operations, safety, and event management. Any adjustments will be applied in a content-neutral manner. All participants must follow staff direction regarding location and movement.
Navarro College - Mexia
Lawn area on the west central side of the south parking lot near the oak tree seating area.
Inclement Weather Protocols:
1. Alternate Location: Covered patio on the back side (south side) of the Administration Building (NCBA).
Navarro College - Midlothian
Center of patio on the eastern side of the building leaving free access to and from the Building 1 through the doors located at either end of the patio area.
Inclement Weather Protocols:
1. Primary Alternate Location: West side of Building 1 (facing Mt. Zion Rd.) within a 15-foot perimeter to the stationary bench on the sidewalk.
Navarro College - Waxahachie
Lawn area immediately east of the Administration Building
Lawn area between WAXB & WAXC
Inclement Weather Protocols:
1. Alternate Location: On the sidewalk in front of Buidling A
An expressive activity area may be reserved and made available for use between the hours of 8 a.m. and 10 p.m., for a total of two (2) business days with no more than two (2) consecutive days in a calendar month if there are no scheduling conflicts and if space is available. If a specific violation of a significant college interest or college procedure violation occurs, the right to use of the expressive activity designated area will be revoked (e.g., disruptive event or invasion of others’ rights).
Enrolled students and employees wishing to use expressive activity areas should request use of the space through the Vice President of Student Success on the Corsicana campus or the Dean’s office at other locations. The “Navarro College Free Speech and Public Assembly" Organized Expressive Activity Form should be completed five (5) days prior to the proposed event. The college reserves the right to relocate any assembly at any time to ensure that the activity does not interfere with the normal operation of the college or interfere with the rights of others.
Speakers
In view of the desire of the College to promote free speech, the expressive activity areas of the campus are open to speakers for whom official arrangements to speak have been made with the College, following the provisions of this procedure.
The Right to Dissent
The right to dissent is the complement of the right to speak, but these rights need not occupy the same forum at the same time. The speaker is entitled to communicate their message to the audience during the allotted time, and the audience is entitled to hear the message and see the speaker during that time. A dissenter must not substantially interfere with the speaker’s ability to communicate or the audience’s ability to hear and see the speaker. Likewise, the audience must respect the right to dissent.
Picketing, Solicitation, and Distribution of Literature
Picketing in an orderly manner or distributing literature within the expressive activity areas is acceptable with the appropriate activity form. Picketing is not permitted inside campus buildings or outside the expressive activity area. Non-commercial literature may be distributed only in the free speech areas.
Posted and Printed Materials Including Posters/Flyers
No signs, posters or advertisements shall be nailed, tied, hung, written or otherwise affixed to any trees, bushes, buildings, walkways, posts, fences, or other college property. Approved materials may only be placed on designated bulletin boards. They must not cover previously posted material and should not extend beyond the edges of the bulletin board. Printed material must not exceed an overall size of 8½” x 11”.
General regulations for the posting of flyers or posters. Advertisements may be placed on all bulletin boards throughout the campus and other Navarro College locations.

Flyer must be typed or produced on a computer. No handwritten posters/flyers are allowed except posters/flyers created for athletic spirit or Homecoming event.

Only one Navarro College or non-college posters/flyers will be approved and stamped by the Vice President of Student Success office, a representative from the Student Development and Engagement office, or location deans.

If the Navarro College Marketing Department creates the poster/flyer they will include an approval stamp.

The individual requesting to have something posted will be responsible for duplicating the approved flyer.

Include the following: Event details (date/time/location) and contact information e-mail address or a QR code. Include a deadline if applicable.
a. Review date/time/location for conflict with any planned Navarro College activity. -
The Navarro College non-discrimination clause must be on all college posters/flyers.

Ensure correct spelling/grammar; no profanity or antisemitism as well as references to alcohol, tobacco, drugs, or related activities.

Approved designated areas – bulletin boards, stairwells, metal around windows, and brick surfaces. Nothing should be posted on painted or stained walls/doors.

Secure with scotch tape at each corner of the poster/flyer. This helps it not to curl; no more than 4 posters per location. Student Development office representatives are responsible for adhering any flyers that are barely adhered to or that are torn.

No personal student postings advertising personal items for sale/rent, roommate requests, babysitting, etc.

Be respectful; do not remove or deface other postings. Do not post over other postings.

Navarro College is not responsible for any items that are torn down or if a person(s) is found responsible for defacing a poster/flyer all those participating individuals will be subject to discipline.

All Navarro College staff members are responsible for monitoring and promptly removing posters/flyers that are believed to be inappropriate or offensive.

Navarro College Marketing and Student Development offices will be responsible for monitoring and removing posters/flyers not approved or past the event dates on an ongoing basis.
Symbolic Protest
During a presentation, individuals are permitted to display signs, gesture, wear symbolic clothing or in silent protest, provided that such actions do not disrupt the proceedings or impedes access. Disruptive activities include those that block the audience’s view, distract from the presentation, incite immediate breach of peace (including acts of antisemitism), threaten the welfare of others, or violate any college regulations or local, state, or federal laws.
Marches, Parades, Protest, Rally
Engaging in peaceful demonstrations (including, but not limited to Marches, Parades, Protest, and Rally) is permitted on Navarro College property. The appropriate activity form should be completed for each campus or location in order to prepare for and facilitate the safety of participants and bystanders. The activity form should outline expected attendance and the planned march/parade route. Protest (See Symbolic Protest above) and Rally locations must follow the guidelines regarding specified Areas Designated for expressive activity reservations. The Free Speech and Public Assembly request form should be submitted at least five (5) business days in advance of the event.
Disruptive conduct will not be permitted and at no time should any of these expressive activities cross thoroughfares, slow or stop traffic. The following applies to specific guidelines for such activity.
1. Handouts, giveaway items, hard candy, and other parade tokens may be handed out as a person walks in the parade/march.
2. Absolutely nothing can be thrown from vehicles or decorated
3. A parade participant, whether he or she is operating a motor vehicle, riding in or on a parade unit, or walking/marching, may not possess, transport, consume, distribute, or be under the influence of alcohol or other drugs at any time immediately before or during the parade.

Volume
The volume of any sound equipment may not exceed 75 decibels (dBA) when measured at a distance of 50 feet from the source of amplification. This ensures that the sound does not interfere with academic activities or other programs occurring in nearby buildings. The use of amplified sound devices, drums, or other percussive instruments during class hours is prohibited if it could interfere with campus operations or intimidate others.
Conduct and Manner of Free Speech and Public Assembly
Those who schedule and/or participate in speech, expression, solicitation or public assembly activities on campus must not:

Threaten, intimidate, or harass passersby.
-
Interfere with, impede, or cause blockage of the flow of vehicular or pedestrian traffic.
-
Commit any act likely to create an imminent safety or health hazard.
-
Interfere with or disrupt any other lawful activity by anyone in the same general location at the same time.
-
Post materials on any walls, windows, doors, sidewalks, trees, light poles, etc., or on any other college equipment except in designated posting areas.
-
Conduct speech that includes antisemitic remarks, inflammatory language, which are those words that by their very utterance tend to incite an immediate breach of peace.
-
Flag Protocol: The lowering of the U.S. or Texas flag to raise another nation's flag or flag representating a group or organization is prohibited.
-
Engage in any other speech or action that is not allowed by law.
Expectations During Free Speech and Public Assembly
Additionally, those involved in any form of a free expression activity on campus must adhere to the following restrictions:

Public speech that is likely to incite or produce imminent lawless action or that is, under the current legal standards, either defamatory or obscene, is prohibited.

In accordance with the Texas Education Code, it is unlawful for any person on any property either owned or controlled by the college to refuse to identify him/herself to a college official in response to a request. A person may identify him/herself by presenting a student or faculty/staff ID card or driver’s license or some other form of government-issued identification.

Individuals who damage or destroy college property shall be held responsible for such damage or destruction. This includes the campus lawns, shrubs, and trees.

Facial Coverings: The use of a mask, facial covering, or other disguise is prohibited during expressive activities if the intent is to conceal the identity of the person to obstruct law enforcement, intimidate others, or interfere with a college employee's duties.

Academic Period Restrictions: During the last two weeks of a semester or term, the following expressive activities that may materially and substantially disrupt the functioning of the institution are prohibited; inviting speakers, using amplified sounds, or using percussive instruments.

A request for use of expressive activity areas may be denied if a college official determines that the proposed speech/activity will constitute a clear and present danger to the college’s orderly operation.
All applicable college policies and regulations, state and federal laws and municipal ordinances should be followed when engaging in activities on Navarro College property. Failure to do so may result in immediate removal from College property and any other appropriate action by College officials and/or Navarro College Department of Public Safety.
Camping
Navarro College upholds a commitment to fostering a clean, aesthetically pleasing, healthy, and safe environment conducive to its work, educational, and living endeavors. In alignment with this commitment, camping activities are strictly prohibited on Navarro College property.
Camping, as defined by the institution, encompasses various activities including sleeping outdoors with or without camping equipment such as tents, tarps, sleeping bags, bedding, hammocks, or cooking gear. Additionally, setting up temporary or permanent sleeping or cooking spaces outdoors, establishing living quarters beyond Navarro College housing, or sleeping in or under parked vehicles are considered violations of this policy.
This applies to all employees, students, College partners, contractors, and visitors.
Camping is not permitted on Navarro College property (this includes all outdoor areas owned, leased, or controlled by Navarro College, and all buildings or permanent structures owned by Navarro College) except as permitted below and with the approval of the Vice President of Student Success, Location Deans, or their designee and may be subject to written request five (5) business days in advance.

Artists or actors: Camping may be permitted for individuals involved in college-authorized performances that necessitate such actions as part of the artistic production, limited to the duration of their scheduled performance or campus activity. Written notification, five (5) days in advance, is required.

Student Activities: Corsicana Campus and Location Administration are committed to an effective Student Life program and are supportive of student clubs and their role in a community college. Camping may be allowed as part of student activities conducted in accordance with College regulations, encompassing events for clubs, organizations, sports events, and all Navarro College partners. Ideas and club opportunities may be discussed with the Student Life Office on the Corsicana campus, Location Deans, or their designees.

Extraordinary circumstances: In exceptional situations, with a written request, camping may be approved with consent from designated College officials by the Vice President of Student Success, Location Deans, or their designee. Such circumstances could be subject to a five (5) business day advance notice requirement.
Policy Violations and Grievance Procedures
Navarro College is committed to ensuring a fair and timely process for addressing any violations of this free expression and public assembly procedure. Any student, employee, or member of the public who believes a violation has occurred may file a grievance.
Initial Grievance Filing: A grievance must first be submitted to the appropriate location dean or the Executive Director of Student Services. The complaint should be in writing and include all relevant details, such as the nature of the violation, the date and time it occurred, the location, and the individuals involved.
Internal Resolution: The location dean or Executive Director of Student Services will review the complaint and attempt to resolve the issue informally within a reasonable timeframe.
Formal Review: If a resolution is not reached at the initial stage, the complainant may escalate the grievance to the Vice President of Student Success. The Vice President of Student Success will review the case, and they may choose to form a committee to further investigate the matter. The committee will gather information, interview relevant parties, and make a recommendation to the vice president.
Final Decision: The decision of the vice president is final and binding on all parties. All parties involved will receive a written notification of the final decision.
